At New England Cranberries, we believe that you have a right to know about the information we collect from you. This Privacy Policy applies to our websites, applications, or website features you use or access (collectively, the “Sites”), as well as any mobile application (each, an “Application” and together with the Sites and Applications, our “Services”).
By using our Services, you consent to the practices set forth in this Privacy Policy, which is incorporated into our Terms of Use.
Please note that this Privacy Policy does not apply to third-party services (each, a “TPS”), such as Facebook, Amazon, or other social network services and commercial partners of New England Cranberries. We are not responsible for their practices, content, or privacy policies. We encourage you to carefully review the privacy policies of any TPS you access so that you know how they will use and share your information.
1. Information Collected or Received
In order to provide and continually improve our Services, we collect information that alone or in combination with other information could be used to identify you (“Personal Information”).
Personal Information we may collect from you includes but is not limited to:
Identification information – including your name and email address, and your shipping and billing address
Financial information – such as your credit card information when completing an order
Communication information – such as when you reach out to us with questions or concerns, or when you voluntarily respond to our requests seeking your opinion and feedback
Commercial information – such as the products or services you have purchased and your purchasing history or tendencies
Demographic information – such as your age or age range
Social Media information – including your contact details, when you choose to interact with our pages on social media sites like Instagram and Facebook. In addition, the companies that host our Social Media Pages may provide us with aggregate information and analytics regarding the use of our Social Media Pages
Online activity and device identifiers – such as your browser information, operating system information, device information, IP address, and the date, time, length of stay and your browsing/search history, including the specific pages accessed during your interactions with Services
We maintain one or more databases to store your Personal Information and may retain it as reasonably required to serve you and operate the Services. Personal Information that we collect depends on how you use the Services. Where we ask for you to voluntarily provide your Personal Information to us, it is your choice to do so. If you choose not to provide us with certain Personal Information, you may not be able to take advantage of many features of the Services.
We aggregate your Personal Information with information collected from other users to (i) provide you with a better experience, (ii) improve the quality and value of the Services and (iii) analyze and understand how our Services are used.
New England Cranberries does not sell products for purchase by children. We sell children’s products for purchase by adults. We do not knowingly collect information from children under the age of 13, in accordance with the Children’s Online Privacy Protection Act. 2. How Information is Collected
We may collect your information in the following ways:
WHEN YOU PROVIDE US WITH INFORMATION TO MAKE A PURCHASE
If you use our Services to make a purchase, we request certain Personal Information for the purpose of facilitating current and future transactions. In an effort to facilitate your payments, we collect certain financial information from you, such as your payment card number and authentication details. We use a payment processor so that we do not need to maintain your credit card information other than in a tokenized form. Our payment processing partner stores and processes your credit card or other payment information using industry-standard security measures. By making a purchase through the Services, you give us consent to use and provide your financial information as we consider necessary to process the transaction.
COMMUNICATIONS YOU INITIATE WITH US
If you contact us in person, by phone, email, instant message, live chat, social media, or by some other means (either through our Services or through TPS), we may keep a record of your contact information and correspondence for later reference. When we send you emails, we may track whether you open them to figure out how to deliver more delightful and helpful emails and improve our Services.
THIRD-PARTY SERVICES (TPS)
If you create your New England Cranberries account by connecting through a TPS, such as Amazon or Facebook, you are authorizing us to use public information from that connected account to help complete your New England Cranberries profile. We collect and store this information and use it to help you connect to our Site. Connecting your New England Cranberries account to a TPS is completely optional, and you will have the opportunity to grant permission when you attempt to connect. Please remember that the manner in which the TPS uses, stores, and discloses your information is governed solely by the policies of such TPS. We recommend that you review the terms and policies of that TPS, including its privacy and data gathering practices. New England Cranberries has no liability or responsibility for the privacy practices or other actions of any TPS or other third-party site or service that may be enabled within the Services.
New England Cranberries partners with TPS who set cookies, pixels, and other tracking technologies on our Sites that collect information about Site visitors and members on our behalf in order for the TPS to deliver their services to us. These services include targeted online advertising and marketing both on and off Services (like showing you offers from third parties on our Sites) and analysis of the information collected through those cookies, pixels, and other tracking technologies. Please note, if you interact with a third-party offer, the collection of information by that third party is governed by the third party’s privacy policy and not this Privacy Policy. In addition, these TPS tracking technologies allow a TPS to recognize you, your computer, or your mobile device each time you visit our Sites and across other sites that also utilize the TPS tracking technologies. TPS may choose to include New England Cranberries widgets on their sites. When you load a site that includes our widgets, we receive analytics information through a cookie and that information is used in accordance with this Privacy Policy, including to enhance our data and to improve our Services. New England Cranberries does not have access to or control over these TPS tracking technologies, and they are not governed by our Privacy Policy. INFORMATION WE AUTOMATICALLY COLLECT
Like most websites, and as mentioned above, our Services incorporate tracking technologies such as “pixel tags”, “web beacons” and “cookies” which allow us to track the actions of our users across time and Services. Pixel tags or web beacons are tracking technologies on websites, ads, and in emails that can monitor the behavior of the user visiting the website, viewing the ad, or receiving the email. Cookies are small files placed on your computer that recognize you when you return to New England Cranberries and that allow us to customize your user experience, deliver relevant ads, and improve the Services. You may modify the cookies that are accepted by your computer by changing your browser settings, or by clicking ‘Manage Preferences’ in the cookie banner popup that appears on your screen, although this may change how the New England Cranberries website is presented to you. Other companies’ use of their cookies is subject to their own privacy policies, and we encourage you to review their policies to better understand their data practices
As an example, New England Cranberries uses cookies to keep track of your shopping cart and for other personalized experiences. We also use tracking technology to create remarketed user audiences based on visitor behavior on our Sites. New England Cranberries may also deliver custom ads based on your affinities, interests, geographic and demographic signals. In particular, New England Cranberries may use other TPS or services such as Google Analytics to monitor activity on the Site and to assist with advertising. Most of the companies with whom we work to provide you with targeted ads support the Self-Regulatory Principles for Online Behavioral Advertising of the Digital Advertising Alliance (“DAA”) (the “Principles”). This means that they allow you to exercise choice regarding the collection of information about your online activities over time and across websites for online interest based advertising purposes. We are not responsible for the effectiveness of, or compliance with, any opt out options or programs, or the accuracy of any other entities’ statements regarding their opt out options or programs. Please note this does not opt you out of being served ads. You will continue to receive generic ads.
We may also collect information when you are visiting our stores. Like most retailers, we have in-store video and user-friendly technology that helps us understand customer behavior within our physical spaces. We may also anonymously collect wireless device signature information while you are near or in our stores to help us better understand our customers.
OPTING OUT OF PROMOTIONAL COMMUNICATIONS
If you decide you do not want to receive marketing emails, you can (i) select to “opt-out” by following the unsubscribe instructions in the email, or (ii) visit your account settings to unsubscribe. Unsubscribing will stop you from receiving most types of communication, but it may not apply to emails about orders or transactions you place through the Services or to respond to your specific request, such as password recovery.
BLOGS, REVIEWS AND TESTIMONIALS
The Services may from time to time offer publicly-accessible blogs, customer reviews or testimonials. Any information you provide in these areas may be read, collected and used by us and others who access them. To request removal of your Personal Information from our blogs, customer reviews or testimonials, please contact us. Please note that in some cases we may be unable to remove your Personal Information.
3. How Information is Used and Shared
We primarily use the information collected for the purpose of enhancing the Services and your experience, and as otherwise described in this Privacy Policy. Except if we sell all or a portion of our business, as described below, we do not sell your Personal Information to anyone as the term “sell” is traditionally understood. We may “sell” your information as that term is defined under new state privacy laws, and we describe those practices below. We share your Personal Information as described in this Privacy Policy.
We share your Personal Information with TPS providers, commercial partners, service providers, and others who we conduct business with to: (i) enhance our Services and evaluate the effectiveness of our partnerships; (ii) provide you with additional services related to our Services; (iii) conduct quality assurance testing; (iv) facilitate creation of accounts; (v) provide technical support; (vi) advertise and market the Services; (vii) facilitate business partnerships with trusted partners and/or (viii) to provide other services to New England Cranberries. Personal Information is also shared with third party marketing partners for commercial purposes, such as serving relevant ads to you both on and off Services.
AGENTS
Generally, we will not disclose your Personal Information to an unaffiliated third-party. However, we provide your Personal Information to our employees, contractors, commercial partners, agents, service providers and designees (“Agents”) where necessary to enable them to perform certain services for us including without limitation: order fulfillment, payment processing, Clean Out Bag processing, website-related services such as web hosting, database management, improvement of website-related services and features, maintenance services and distribution of offers, business partnerships, partner promotions, advertisements and other marketing materials on our behalf.
We may also provide our Agents with de-identified or aggregate information for any purpose not prohibited by law, including indicating the demographic information of users on our Sites, buying behavior, and opportunities to market to select segments of our users indirectly. When we share de-identified or aggregate information, it is done in a way that cannot identify you.
HOW WE RESPOND TO DO NOT TRACK SIGNALS
Some web browsers (including Safari, Internet Explorer, Firefox and Chrome) incorporate a “Do Not Track” (“DNT”) or similar feature to signal that a user does not want to have his or her online activity and behavior tracked. If a website responds to DNT signals, the browser can block that website from collecting certain information about the browser’s user. Note, however, there is no industry consensus as to what site operators should do with regard to these signals. Accordingly, unless and until the law is interpreted to require us to do so, we do not monitor or take action with respect to DNT signals or other mechanisms. USE OF SERVICES VIA MOBILE DEVICE
If you use the Services through your mobile device, we may receive a unique identifier or information about your location. You may at any time prevent the Services from using your location by turning this option off at the device level. When you use the Services through your mobile device, we also collect device type and UUID, a unique identifier generated within the Application, and store this information in log files and system databases. We use this information to provide you with the most up to date application and features, or to advertise or promote products or services to you that are applicable to your device type.
BUSINESS TRANSACTIONS AND TRANSFERS
If we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, New England Cranberries customer information (including Personal Information) will likely be shared for evaluation purposes and included among the transferred business assets. If an acquirer that has assumed all or part of our business materially alters how it uses or shares your Personal Information than at the time of initial collection, the acquirer will provide prior notice of the new or changed practice.
COMPLIANCE WITH LAWS AND LAW ENFORCEMENT
New England Cranberries cooperates with government and law enforcement officials and private parties to enforce and comply with the law. We will disclose any information about you to government or law enforcement officials or private parties as we, in our sole discretion, believe necessary or appropriate to respond to claims and legal process, to protect our rights or the rights of our users or others, to protect the safety of the public or any person, or to prevent or stop activity we may consider to be illegal, unethical or legally actionable activity, including but not limited to third party intellectual property infringement. We reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to accomplish the foregoing.
4. Data Retention
We keep Personal Information for as long as reasonably necessary for the purposes described in this Privacy Policy, while we have a business need to do so, or as required by law (e.g. for tax, legal, accounting, or other purposes), whichever is longer.

Where provided for by law and subject to any applicable exceptions, California residents have the right:

While the California Privacy rights listed above only apply to California residents, we believe that everyone should have the same privacy rights regardless of where you live. The listed privacy rights are available to all of our customers, regardless of where they live. VERIFICATION
After we receive your request, we may request additional information from you to verify your identity. If we cannot verify your identity, we will not provide or delete your Personal Information.
AUTHORIZED AGENTS
Your authorized agent may submit requests in the manner described above, although we may require the agent to present signed written permission to act on your behalf, and you may also be required to independently verify your identity with us and confirm that you have provided the agent permission to submit the request.

NOTICE OF FINANCIAL INCENTIVES
Financial incentives, as defined under the CCPA, include “programs, benefits, or other offerings, including payments to consumers as compensation, for the disclosure, deletion, or sale of personal information about them.” Although we do not consider our discounts and offerings to be “financial incentives,” each may be interpreted to be one under California law.
We offer discounted prices to consumers who sign up for our offerings and voluntarily provide us with certain requested personal information to be used in accordance with this Privacy Policy. For example, as part of New England Cranberries Rewards you may choose to voluntarily provide us with your birthday so that we may send you a special reward on your birthday. You can opt-in by submitting the requested personal information. You can withdraw your consent at any time by emailing us , with “Opt-out of Financial Incentives” in the subject line.
We generally do not treat consumers differently if they exercise a privacy right under California law. However, you will need to provide some personal information in order to receive certain discounts or benefits. In such circumstances, we offer a price difference that is reasonably related to the value of your data to us in connection with the discount or benefit.
6. Notice to Non-US Residents
INTERNATIONAL USERS CONSENT TO TRANSFER
The Services are hosted in the United States. If you are visiting the Services from outside the United States, your information may be transferred to, stored and processed in the United States in accordance with this Privacy Policy and applicable United States laws. Please note that data protection and other applicable laws of the United States may not be as comprehensive as those laws or regulations in your country or may otherwise differ from the data protection or consumer protection laws in your country.
